瑞典一直嘗試著自己的獨特管理方法:出賣性服務是合法的,但是購買性服務卻是犯罪。因而,當妓女的顧客被捕的時候,她卻自由自在。瑞典政府的法律文獻所陳述的法律解釋如下:

“在瑞典,賣淫被認為是一種男性侵犯婦女兒童的暴力。它被正式公認為一種對婦女兒童的剝削行為,並且會導致一個嚴重的社會問題,即不僅傷害了個體形式的賣淫婦女或兒童,而且普遍地傷害了社會……。只要男人通過嫖妓來購買、銷售和剝削婦女兒童,性別平等將仍然難以達到。”

自從這部法律1999年頒佈以來,支持者把它作為一項巨大的成就予以高度讚揚,而且把它推薦給了其它的立法機構。而反對者把它作為一個徹頭徹尾的失敗予以猛烈的抨擊,而且已經警告其它國家不要步瑞典的後塵而犯同樣的錯誤。這種常常激昂的紛爭,涉及到大量多種多樣法律的、心理上的、社會的和經濟上的難於驗證的論據和主張。在本教程裏,我們因此不得不羅列針對論爭雙方就此論題的一些原始資料。

Prostitution: Legal Aspects 3

A unique approach is being tried in Sweden: Selling sexual services is legal, but buying them is a crime. Thus, a prostitute walks free when her customer is arrested. The rationale behind this legislation is stated in the government's literature on the law:

"In Sweden prostitution is regarded as an aspect of male violence against women and children. It is officially acknowledged as a form of exploitation of women and children and constitutes a significant social problem, which is harmful not only to the individual prostituted woman or child, but also to society at large.... Gender equality will remain unattainable so long as men buy, sell and exploit women and children by prostituting them."

Since the enactment of this law in 1999, proponents have praised it as a great success and recommended it to other legislatures. Opponents have denounced it as a complete failure and have warned other countries against making the same mistake as Sweden. This often passionate debate involves a great variety of legal, psychological, sociological, and economic arguments and assertions that are not easily verified. In the present course, we must therefore be content with pointing to some original sources on both sides of the issue.
